On June 22, 1963, two representatives of appellant Prudential Insurance Company, Raymond Boos and Melvin Dole, met with respondent, Margaret Delaney, in her home to discuss the purchase of a surgical and hospital insurance policy. At that time she had a Blue Cross-Blue Shield health policy. Boos filled out the application, which was a standard form consisting of 35 questions, after eliciting the required information from respondent. Respondent answered "Yes" to questions 28a and 28b which inquired whether she had "been in any hospital . . . for observation, rest, diagnosis, treatment or advice" and whether she had "had any surgical operations." By way of elaboration (question 35), she reported that she was hospitalized in November, 1954, for pneumonia and in October, 1957, for a hemorrhoid operation. She denied (question 30) having been attended by a physician on occasions other than those disclosed in question 28, and did not know (question 31) of "any physical disorder, disease, defect, or abnormality" other than those designated in questions 28 and 30. Respondent testified that she then signed the application without reading it.
